Section 7 exemptions
New mineral industries regulations commence on 1 July 2019. This page is being reviewed and may require updates.
Under Section 7 of the Mineral Resources (Sustainable Development) Act 1990, the Minister may grant an exemption to prevent a licence from being issued within a certain land area. An exemption can be granted for any reason the Minister deems necessary as outlined in the Act.
Areas that currently have exemptions under Section 7 of the Act can be viewed at GeoVic.
How to view current exemptions
To view all current exemptions in Victoria, go to GeoVic:
- Click on the 'Add Layers' button to open the layer menu.
- Once the layers menu is open, follow this path in the directory:
Land Status and Boundaries → Industry Related Land → Minerals → 'Unavailable S7 Exempt Areas (MRSDA)'.
Once ticked and applied, GeoVic will display all current exempt areas in Victoria.
Revocation of Section 7 exemptions
The Minister may issue a notice to revoke land from being exempt, making the land available for a license again on or after the date set by the Minister in the notice.
